Premitted Use Process
A permitted use is an activity that is allowed as a "matter of right" as long as the
proposed development meets the prescribed performance standards for the zone
in which the proposed use is located. A use allowed as a "matter of right" means
that the Zoning Enforcement Officer may approve the zoning compliance permit
rather than the Commission. As with conditional uses, each zoning district has
a listing of permitted uses allowed in that district.
The following information must be provided with the application for a permitted use:
(1) Type of use.
(2) The address of the property.
(3) Whether the property is in the city or unincorporated area to the county.
(4) The owner of the property.
(5) The size of the property in acres.
(6) Whether public sewer or septic tank will be used.
(7) Whether there is a creek, stream or drainage way on the property.
(8) Location of the 100-year flood plain if located on the property.
(9) If the proposed use is commercial or industrial activity, then the square footage of each floor must be provided.
(10) For restaurants and places of assembly, the number of seats must be provided.
(11) Additional information and/or departmental approval as required by the Zoning Enforcement Officer
As a part of the application process a site plan may be required.
The site plan must contain:
(1) Property lines and dimensions
(2) Location and uses of existing and proposed structures.
(3) Curb cuts.
(4) Easements.
(5) Water courses and fences.
(6) Parking areas.
(7) Street and alley names and rights-of-ways lines.
(8) Other information that may affect the application
Process for Permitted Use Permit:
1) Application submitted with site plan.
2) ZEO reviews application to determine if regulations are complied with.
3) If approved Certificate of Zoning Compliance is issued
4) If denied, an appeal of ZEO decision must be done within 7 days of denial of the application.
